1. Overview

SwayGifts LLC ("we", "us", "our") provides a global digital platform for sending and receiving personal gifts that may include monetary value and media messages. By using our site or app, you agree to these Terms and our Privacy Policy.

2. Nature of Service

SwayGifts is not a crowdfunding, donation, or stored-value wallet service. Each gift is processed through Stripe Connect, where the platform charges the sender and transfers funds to the recipient's connected Stripe account. Recipients receive funds via Stripe's automatic payout schedule to their bank account. We do not hold or pool funds. SwayGifts itself is not a bank, payment institution, or money transmitter, except as permitted by applicable laws.

3. Accounts and Verification

To create an account or send a Gift, you must be at least 18 years old, or a verified Custodian acting on behalf of a minor account. Users must provide accurate and current information when registering or claiming a Gift. Recipients may need to complete identity verification (KYC) depending on their country. This ensures compliance with local financial and anti-fraud laws.

Custodian-Held Accounts

Accounts held for children must be created and managed by a verified adult parent or guardian. Here's how it works:

  • The Custodian is the sole contracting party and manages all account activity.
  • Minors have view-only access. They cannot fund, withdraw, or verify transactions.
  • The Custodian is responsible for all supervision, compliance, and account actions.

When the minor reaches the age of majority, and after verification, the account may be transferred to the now-adult User, or be closed, with any unclaimed balance re-issued accordingly. Both the Custodian and the minor may need to complete identity verification (KYC) before ownership changes.

4. Payments and Fees

All payments are processed through Stripe, our regulated, PCI-compliant payment partner. When you send a gift, funds are charged to your payment method. Once the recipient verifies their identity, funds are automatically transferred to their connected Stripe account and then deposited to their bank account via Stripe's automatic payout schedule. SwayGifts facilitates these transfers but does not store or hold funds as a wallet service. All applicable fees are displayed before checkout. SwayGifts never stores your payment details.

5. Refunds and Expiration Policy

This Refunds and Expiration Policy sets out how SwayGifts manages refund requests, expired gifts, and claim timelines. It applies to all users who send or receive digital gifts ("Gifts") through the SwayGifts Platform.

How long does a recipient have to claim a Gift?

Recipients have 14 calendar days from the date of issue to claim their Gift. If the Gift isn't claimed within that time:

  • It automatically expires, and
  • The sender may contact support@swaygifts.com for guidance on retrieving the expired Gift.

Please note: SwayGifts may send reminder emails before expiry, but these are not guaranteed.

Can I get a refund for an unclaimed Gift?

Yes, refunds may be considered if:

  • The Gift was not claimed within the 14-day claim period;
  • A duplicate or technical error occurred during the transaction; or
  • A regulatory or compliance issue (such as sanctions or failed KYC verification) prevents the transaction.

When will refund requests be rejected?

Refund requests will generally be rejected if:

  • The Recipient has already claimed or redeemed the Gift;
  • The Sender entered incorrect recipient details or payment account information; or
  • The refund would violate applicable laws or financial regulations.

Each case is assessed individually, and SwayGifts reserves the final decision on all refund outcomes.

How do I request a refund?

If your Gift has expired and meets the refund conditions:

  1. Email your request to support@swaygifts.com within 30 calendar days after the Gift expires.
  2. Provide necessary details such as:
    • Transaction ID or proof of purchase
    • Sender and recipient information
    • Reason for the refund request

You may be asked to provide identity verification or other documentation. SwayGifts may deduct a reasonable administrative or processing fee from the refund amount.

6. Privacy and Data Security

We comply with global privacy standards, including GDPR and CCPA. All personal data is encrypted, securely stored, and never sold or shared beyond what is necessary to process your transaction.

Who controls my data?

SwayGifts LLC (United States) is the primary data controller for users worldwide. SwayGifts Pty Ltd (Australia) acts as a data processor, managing infrastructure, analytics, and secure storage under strict data transfer safeguards.

What personal information does SwayGifts collect?

We collect only the information necessary to deliver and improve our services, including:

  • User Information: Name, email, phone number, account details, and recipient info.
  • Payment Information: Transaction data and billing details (note: we never store full card information).
  • Gift Content: Media, text, and other content uploaded by users.
  • Technical Data: IP address, device type, browser details, cookies, and session activity.
  • Compliance Data: ID verification, proof of payment, and fraud-prevention indicators.

How does SwayGifts use my data?

We use your personal information to:

  • Create and deliver digital Gifts;
  • Verify identity and prevent fraud;
  • Process payments and refunds;
  • Personalize and enhance your experience;
  • Communicate important updates or support information; and
  • Comply with legal or regulatory obligations.

Does SwayGifts share my data with anyone?

Yes, but only with trusted service providers who help us operate safely and efficiently. These include:

  • Payment processors and financial partners,
  • Hosting and analytics providers,
  • Customer support platforms, and
  • Regulators or law enforcement, when required by law.

We do not sell or rent your personal information to third parties.

7. Intellectual Property

All software, branding, and content belong to SwayGifts LLC. Users retain rights to their personal messages, photos, and videos shared through the platform.

8. Limitation of Liability

SwayGifts acts as an intermediary between senders and recipients and cannot be held responsible for payment processor delays, verification issues, or outages caused by external services.
