These Terms apply to all users of SwayGifts worldwide. If you have any questions, contact us and we’ll assist as soon as possible.
1. Overview
SwayGifts LLC (“SwayGifts”, “we”, “us”, or “our”) provides a personalized digital gifting and celebrations platform that allows users to create, share, and deliver digital gifts that may include an associated monetary component and media messages. By accessing or using our website or application, you agree to be bound by these Terms and our Privacy Policy.
2. Nature of Service
SwayGifts is a digital gifting platform and does not provide crowdfunding, donation, wallet, or stored-value services. Each gift represents a one-time digital gifting service tied to a specific recipient or event.
Payments are processed through Stripe Connect. SwayGifts charges the sender for the applicable digital gifting service and routes the associated payout to the recipient’s verified Stripe Connect account in accordance with Stripe’s standard payout schedule. SwayGifts does not hold, pool, store, or manage customer funds as a balance or wallet.
SwayGifts is not a bank, payment institution, or money transmitter. Payment processing, identity verification, and payouts are provided by Stripe and other regulated financial partners, subject to their respective terms and applicable laws.
3. Accounts and Verification
To create an account or send a Gift, you must be at least 18 years old, or a verified Custodian acting on behalf of a minor account. Users must provide accurate and current information when registering, sending, or receiving a Gift.
Recipients may be required to complete identity verification (KYC) through Stripe depending on their country and applicable regulations. Failure to complete required verification may prevent receipt of a Gift.
Custodian-Held Accounts
Accounts created for children must be managed by a verified adult parent or legal guardian (“Custodian”).
- The Custodian is the sole contracting party and controls all account activity.
- Minors have view-only access and cannot send gifts, receive payouts, or verify accounts.
- The Custodian is responsible for all compliance, supervision, and account actions.
Upon reaching the age of majority, and subject to verification, account ownership may be transferred to the now-adult user or closed. Any unclaimed gift amount will be handled in accordance with applicable laws and these Terms.
4. Payments and Fees
All payments are processed through Stripe, our regulated and PCI-compliant payment partner. When you send a Gift, you are charged at checkout for a one-time digital gifting service tied to a specific recipient or event.
Once the recipient completes verification to receive funds via Stripe Connect, the payout is automatically routed to their connected account according to Stripe’s standard payout schedule. SwayGifts does not offer wallets, stored balances, or reusable funds and does not store payment credentials.
All applicable fees are displayed before checkout. Fees may include payment processing fees, currency conversion fees, and SwayGifts’ service fee.
5. Refunds and Expiration Policy
Recipients have fourteen (14) calendar days from the date a Gift is issued to complete the steps required to receive the Gift.
If a Gift is not completed within this period, it may expire. Senders may contact support@swaygifts.com for assistance regarding expired Gifts.
Refund Eligibility
- The Gift was not completed within the claim period;
- A duplicate charge or technical error occurred; or
- Regulatory or verification requirements prevented completion.
Refunds are reviewed on a case-by-case basis and may be subject to administrative or processing fees. Refunds are not available once a Gift payout has been completed.
6. Privacy and Data Security
SwayGifts complies with applicable privacy laws, including GDPR and CCPA. Personal data is collected and processed only as necessary to operate the platform, prevent fraud, and comply with legal obligations. For details, please review our Privacy Policy.
7. Intellectual Property
All software, branding, and platform content are owned by SwayGifts LLC. Users retain ownership of personal content they upload, subject to the licenses required to operate the service.
8. Limitation of Liability
SwayGifts acts as a platform provider and is not responsible for delays, errors, or outages caused by third-party services, including payment processors or financial institutions.
